Sharesies Apple Pay Terms and Conditions

These Sharesies Apple Pay Terms and Conditions (Apple Pay Terms) apply to your use of Apple Pay with the Spend Service. They are a supplement to, and must be read together with, the General Terms, which sets out the general terms relating to use of our Services, and the Spend Terms and Conditions (Spend Terms). The meaning of capitalised words used in the Apple Pay Terms is set out in the Dictionary at the end, or is defined in the General Terms or Spend Terms.

If there is any conflict between these Apple Pay Terms, and any other applicable terms that apply to Sharesies products and services, then these Apple Pay Terms will apply, but only with respect to the use of Apple Pay.

You must also agree to Apple’s Apple Pay Terms and Conditions in order to register your Sharesies Debit Card and use it with Apple Pay. 

Transactions made using Apple Pay are treated as Contactless Transactions.  

1. Using and managing Apple Pay

(a) You can add a Sharesies Debit Card to Apple Pay on Apple devices.

(b) You will be verified when adding a Sharesies Debit Card to Apple Pay. 

(c) Once you have added your Sharesies Debit Card to Apple Pay and been verified, you may make online or in-app payments, or Contactless Transactions using Apple Pay.  You may be required to enter your Sharesies Debit Card PIN into the merchant's terminal or enter your mobile phone security credentials (e.g., PIN, passcode or biometric identifier) on your Apple device to complete a transaction.

(d) Instructions on how to add, or remove a Sharesies Debit Card from Apple Pay are available in-app or in our Help Centre, or through the New Zealand Apple Pay website. Alternatively, you can also ask us to remove your Sharesies Debit Card by contacting Sharesies’ Customer Wealth team.

(e) Apple Pay is a payment platform made available by Apple, and not by Sharesies. We are not responsible for any loss you may suffer in relation to:

  • any error, defect or unavailability of Apple Pay or any Apple devices; or

  • any failure or refusal of merchants to process transactions using Apple Pay.

2. Sharing and using information

We may exchange information (including information about you and your Apple device) with Apple and our third party service providers in relation to your set up and use of Apple Pay.  By using Apple Pay you agree that:

(a) Apple may provide us with information about you, such as your Apple device details (including device type and model and any paired iOS device, device IP address, language, device name, iTunes and App Store account activity, location information if you have location services enabled) and other information to help us identify fraud, and for security purposes.  We may use the information that Apple provides us about you for any purpose related to your use of a Sharesies Debit Card in Apple Pay, including to:

  • enable your Sharesies Debit Card to be used with Apple Pay;

  • provide you customer support and assist you;

  • resolve customer disputes;

  • facilitate accounting, auditing, billing, reconciliation, and collection activities;

  • detect and manage fraud, or for other security purposes;

  • to improve and promote Apple Pay;

  • for internal analytics; and/or

  • comply with applicable law and regulations and to respond to regulatory requests.

(b) We may provide information about you to Apple and our third party service providers that we use to enable your use of Apple Pay.  This includes disclosing information about suspected security breaches or fraud.

(c) Apple and these third party service providers may use information we provide them to:

  • enable you to set up and use Apple Pay;

  • help prevent and detect security breaches and fraud;

  • comply with applicable laws and regulations;

  • respond to regulatory and government inquiries;

  • manage and generally improve Apple Pay and other Apple products.

(d) Apple may also collect and use your information in accordance with its own privacy practices.  Please refer to Apple’s privacy policy (at www.apple.com/nz/legal/privacy/en-ww/).

(e) If you do not want us to collect, hold, disclose or use information as set out in this section, you should not register a Sharesies Debit Card for use with Apple Pay.  

(f) We may also collect, hold, use, disclose and manage your information in accordance with other Sharesies terms and conditions that apply to your use of Sharesies products and services. Our privacy policy contains more general information about how we collect and handle your information. 3. Security Requirements for Apple Pay

You must take all reasonable steps to secure your Apple device on which your Sharesies Debit Card has been registered with Apple Pay.  When you use your Sharesies Debit Card with Apple Pay you are also responsible for ensuring that:

  • any password of your Apple device is kept secret and secure, not easily guessed, not shared with another person (and not stored on or with your device).

  • no one else’s biometric identifier is registered on your Apple device.

  • your Apple device is not left unattended, is locked when not in use, and up-to-date software is installed.

  • you only use Apple Pay on your Apple device or an Apple device that you are authorised to use and not on a shared device.

  • no one else uses your Apple device to make transactions.

  • any Sharesies Debit Cards are unlinked/removed from your Apple device before disposing of it.

  • you follow the requirements in the Spend Terms, the General Terms, and in-app for keeping your Sharesies Debit Card and Account secure and to prevent fraudulent use, including in relation to setting and protecting your PIN.

If you do not comply with the requirements in this section, or if you have acted fraudulently or negligently, you may be treated as having caused or contributed to loss arising from the unauthorised use of your Sharesies Debit Card.  The amount of potential liability you may have is set out in the Spend Terms and General Terms. 

If Apple Pay is activated on your Apple device, anyone who can unlock your device can transact with a Sharesies Debit Card loaded to Apple Pay. You’ll be liable for all transactions made with your Sharesies Debit Card using Apple Pay, whether or not you’ve actually authorised them. For example, if you share your Apple device with someone, you will be solely responsible for any transactions made, even if these are made without your knowledge. We’re not responsible for any loss arising from any such unauthorised transaction(s). The only exception to this, is that you won’t be liable for unauthorised transactions made with your Sharesies Debit Card using Apple Pay during a period where you’ve advised us immediately that you know or suspect that someone else may be able to unlock your Apple device and you’ve asked us to block Apple Pay transactions on your Sharesies Debit Card. This exception won’t apply if you’ve acted dishonestly or negligently.

4. What to do if there is a Problem

You should check your transaction history regularly to make sure there are no errors or unauthorised transactions.  You must notify us immediately if:

  • your Sharesies Debit Card or Apple device has been lost or stolen.

  • you suspect someone else has used your Account without your permission or may have access to your Apple device or know your security credentials or PIN.

  • you know or suspect that another person may be able to unlock your Apple device and/or store their biometric identifiers on your Apple device.

You should immediately remove your Sharesies Debit Card from Apple Pay if your Apple device is stolen or lost. Instructions on how to remove your Sharesies Debit Card are available in our Help Centre or on the Apple Pay website and the Apple Wallet app.

5. Fees and Charges

We do not charge any additional fees for registering and using your Sharesies Debit Card with Apple Pay. However, you may need to pay any third party fees and charges associated with downloading, registering and using Apple Pay on an Apple device, including any applicable surcharges.

6. Rights we have

In addition to our rights of suspension and/or termination in the Spend Terms, we may suspend or terminate use of your Sharesies Debit Card with Apple Pay without prior notice at any time, including if:

  • you ask us to suspend or close the Account that the Sharesies Debit Card is linked to.

  • you breach these Apple Pay Terms.

  • we suspect unauthorised transactions have occurred.

  • we are required to by law or by a regulatory or government body.

7. Change to terms

We may make changes to these Apple Pay Terms from time to time, as set out in section 8 of the General Terms. 

8. Governing law

These Apple Pay Terms are governed by New Zealand law.

9. Definitions

"Apple"

Apple, Inc. and/or its subsidiaries, affiliates and related entities.

"Apple device"

any Apple equipment or Apple device that supports Apple Pay and is used to access your Account, including an iPhone mobile phone, Apple Watch, iPad tablet or MacBook.

“Apple Pay”

the mobile payment and digital wallet service created by Apple that lets users make online, in-app or contactless transactions using certain Apple devices and eligible cards registered on such Apple devices.

"Apple Wallet app"

the app made available by Apple to facilitate Apple Pay payments.

"Contactless Transaction"

a payment or transaction made using your Apple device at a contactless reader. 

"Sharesies Debit Card"

the Sharesies Debit Card (including renewal, replacement and additional cards).   You will be notified if your Sharesies Debit Card is eligible when you attempt to register it with Apple Pay.

"we", "us", "our", or "Sharesies"

Sharesies Financial Limited.

"you" or "your"

the person that holds the Sharesies Debit Card that is used for Apple Pay.

10. Trademarks

Apple, the Apple logo, Apple Pay, Touch ID, Face ID, iPhone, iPad, MacBook, iTunes and Apple Watch are trademarks of Apple Inc., registered in the U.S. and other countries. App Store is a service mark of Apple Inc., registered in the U.S. and other countries.
